Abstract: The following article deals with some major aspects concerning the application of the so-called Dublin rules. We will identify concrete problems which the Dublin system causes in the field of European human rights protection. With a view to possible human rights violations in the context of the Dublin system, we will analyze relevant judgments issued by the European Court of Human Rights and the European Court of Justice. Furthermore we will point at possible consequences which recent human rights jurisprudence may have on the basic principle of mutual trust between Member States. Resumé: Následující článek se zabývá některými z hlavních aspektů aplikace tzv. dublinských pravidel. Chceme ukázat, jaké konkrétní problémy způsobuje Dub linský systém v oblasti evropské ochrany lidských práv. S ohledem na možné po rušování lidských práv vzniklé v rámci Dublinského systému hodláme analyzovat relevantní rozsudky Evropského soudu pro lidská práva a Soudního dvora EU. Dále chceme poukázat na možné důsledky, které tato nová judikatura může mít na zá kladní princip vzájemné důvěry mezi členskými státy. Teaches and conducts research in issues concerning International and European Law and International Human Rights Law.
