CYIL 2015
PAVEL ŠTURMA CYIL 6 ȍ2015Ȏ respect of three above mentioned topics under (b), (c) and (d). All the new draft conclusions on Identification of customary international law, as well as draft articles, principles or guidelines in three other topics were adopted just by the Drafting Committee, and the Commission as a whole only took note of the report presented by the Chairman of the Drafting Committee. During the first part of the session, the Commission also reconstituted one Study Group on the Most-Favoured-Nation clause (Chairman: Mr. D.M. McRae). At its meeting on 12 May 2015, the Planning Group decided to reconstitute the Working Group on the Long-term Programme of Work. The Working Group also discussed, on the basis of the submitted working papers, its methods of work and two new proposals of possible subjects for the Long-term programme. However, due to lack of time, the Working Group had only two meetings during the first part and no meeting during the second part of its session. Therefore it was not able to take any decision on new subjects. At its meeting on 27 May 2015 the Commission also decided to include the topic “Jus cogens” in its programme and to appoint Mr. Dire Tladi (South Africa) as the Special Rapporteur for the topic. On the other hand, the Commission adopted the final report on the topic “The Most-Favoured-Nation clause” and decided to conclude its work on the topic. In addition, the ILC had a number of meetings with representatives of other legal bodies, such as the International Court of Justice (visit of its President Ronny Abraham), the Asian-African Legal Consultative Organization (AALCO), the Inter-American Juridical Committee, the Committee of Legal Advisors on Public International Law (CAHDI) of the Council of Europe, the African Union Commission on International Law and the United Nations High Commissioner for Human Rights. In the same vein, an informal exchange of views was held between members of the Commission and the International Committee of the Red Cross on topics of mutual interest, at the occasion of the invitation to the premises of the ICRC Headquarters. The ILC had also to deal with a casual vacancy. On 8 May 2015 the Commission elected Mr. Roman A. Kolodkin to fill the vacancy occasioned by the resignation of Mr. Kirill Gevorgian, who became Judge of the International Court of Justice. Last but not least, during the second part of the session of the ILC, the International Law Seminar took place at the Palais des Nations. At its fifty-first session, a number of members of the Commission gave lectures on a large variety of topics. 3 3 The Work of the International Law Commission (Ernest Petrič), Jus Cogens (Dire Tladi), State Succession in Relation to State Responsibility (Pavel Šturma), Immunity of State Officials from Foreign Jurisdiction (Concepción Escobar Hernández), Protection of the Atmosphere (Shinya Murase), Subsequent Agreements and Subsequent Practice in Relation to Treaty Interpretation (Georg Nolte), Identification of Customary International Law (Michael Wood), Protection of the Environment in relation to Armed Conflict (Marie Jacobsson), and Crimes Against Humanity (Sean Murphy).
