This brings us to the closing point that is actually the main concern behind the whole case, namely, that the incorrect application of the EU law by national courts would negatively touch the rights of the parties of the case. Any misleading application of the EU law would cause injustice and compromise individual rights. This may concern not only property rights of financial institutions, as was the case in CCB but also more sensitive personal rights of individuals. The CCC should have this in mind in every decision that might decrease the protection of the individuals.
