THE NEW TREND OF INTERNATIONAL ENVIRONMENTAL LAW: FORMATION AND ESTABLISHMENT OF CUSTOMARY RULES Silvano Denega Souza

Abstract: General international law is positively under the effect of the fragmentation phenomenon, which causes it to be subdivided into other more specific areas. In this context, international environmental law is structured and frequently invigorated by new challenges inherent to contemporary life. However, in order to subsist as a special self-contained regime with its own object, methodology and principles, international environmental law, a lex specialis , must find its sources and, above all, dominate them. Therefore, custom reveals to be a convergence point, indispensable to determine the future of global environmental protection. This is the underlying rationale for this article, truly an invitation to perception, after all, the analysis of the formation of international environmental law – also an outcome of state mobilization – could constitute remarkable evidence of the role of custom in the normative setting process. Resumé: Obecné mezinárodní právo je pod vlivem fragmentace práva, která vede k jeho dalšímu členění na speciální právní oblasti. Rovněž mezinárodní právo životního prostře- dí reaguje na nové výzvy a dochází k jeho dalšímu strukturování. Pokud by však mělo být uznáno za zvláštní samostatné právní odvětví se svým vlastním předmětem, metodou a principy, mezinárodní právo životního prostředí, jako lex specialis , musí najít své vlastní zdroje a rovněž je plně obsáhnout. Ukazuje se, že konvergenčním bodem, který je nezbytný pro právní vymezení budoucnosti globální ochrany životního prostředí jsou principy oby- čejového práva. Uvedená teze je také základním východiskem tohoto článku, který v rámci analýzy formování mezinárodního práva životního prostředí – včetně vlivu regulačních zá- sahů státu – může představovat potvrzení role obyčeje v procesu tvorby jeho norem. Introduction International environmental law has been under thorough normative development for almost four decades, a period when the most relevant environmental protection treaties were discussed and approved worldwide, including under the auspices of the United Nations. Furthermore, the rise and stabilization were witnessed of important environmental principles that currently and comprehensively guide international environmental issues. Marked by the dynamism of its instruments, international environmental law has gradually advanced a paradigm shift, notably a transition from a reactive to a precautionary approach, much needed in fact since environmental concerns demand fast collective solutions, considering
