LEGALITY OF TARGETED KILLINGS UNDER INTERNATIONAL LAW Josef Mrázek

Abstract : The targeted killings of human beings raise serious legal questions from the view of jus ad bellum and jus in bello . The use of targeted killings undoubtedly has political, moral, and military consequences which should not be ignored. A few states, particularly, the U.S. and Israel have adopted policies permitting the use of targeted killings not only before an “imminent” an armed attack and in armed conflicts, but also in peace-time and even in territories of the third-states. Targeted killings policies or “ programs ” have been mostly justified as a “ legitimate response to terrorist attacks” or “ threats ”. This paper is trying to analyze the notions of “ targeted killings ” and “ assassination ” or “ extrajudicial execution ”. Military unmanned vehicles (drones) with Hellfire missiles have been used the most frequently for targeted killings. The author deals with the policy of targeted killings in the framework of “ inherent right of self-defense against non-state actors” . The paper critically evaluates policies of targeted killings based on the claim of “continuing right of self-defense” or “continuing imminent threat”. Targeted killings in the territories of the third countries without their permission and with sometimes dubious “ consent ” has been very controversial or illegal. Targeted killings operations also revealed the current legal gap and tension between crucial prosecution of terrorism and addressing terrorist attacks as military (armed) acts. Resumé: Cílené zabíjení lidí vyvolává závažné právní otázky z hlediska jus ad bellum a jus in bello . Cílené zabíjení má nepochybně své politické, morální i vojenské důsledky, které nelze ignorovat. Některé státy, zejména U.S. a Izrael uplatňují politiku umožňující cílené zabíjení nejen před hrozícím útokem a v průběhu ozbrojeného konfliktu, nýbrž i v době míru a dokonce na území třetích států. Politika nebo “programy” cíleného zabíjení jsou vět- šinou ospravedlňovány jako “ legitimní odpověď na teroristické útoky ” nebo “ hrozby ”. Tento článek se snaží analyzovat pojmy “ cíleného zabíjení ”, “ atentátu ” nebo “ mimosoudní popravy” . Nejčastěji se pro cílené zabíjení používají vojenská nepilotovaná zařízení vybavená raketami. Autor se zabývá politikou cíleného zabíjení v rámci “ přirozeného práva na sebeobranu proti nestátním aktérům ”. Kriticky hodnotí politiku “cíleného zabíjení” spočívající na zdůvodnění o “ pokračujícím právu na sebeobranu ” nebo “ pokračující iminentní (bezprostřední) hrozbě ”. Velmi kontroverzní nebo dokonce nelegální je cílené zabíjení osob na území třetích států bez jejich souhlasu těchto států nebo někdy i s pochybným souhlasem. Tyto operace rovněž odhalily právní mezeru a napětí mezi trestním stíháním terorismu a chápáním teroristic- kých činů jako vojenské (ozbrojené) akce.
