alla tymofeyeva CYIL 12 (2021) PUBLIC CORPORATIONS UNDER THE EUROPEAN CONVENTION ON HUMAN RIGHTS Alla Tymofeyeva Abstract: This paper’s objective is to examine the position of public corporations under the provisions of the European Convention of Human Rights (ECHR) while also considering the idea of their subjectivity in international law. In order to reach this goal, the author, first evaluated the legal standing of public corporations; as the applicants based on the provisions of Article 34 of the ECHR and the second, discussed the issue of the attribution of conduct of public corporations to the state as set forth in Articles 4, 5, and 8 of the Articles on Responsibility of States for Internationally Wrongful Acts (ARSIWA). The author concludes that certain types of public corporations have obtained the victim status in the proceedings before the European Court of Human Rights (‘ECtHR’) and consequently, it is possible to speak about their subjectivity in international law. In order to determine whether an entity may claim to be a victim of human rights violations, the ECtHR elaborated ‘the NGO test’, which reflects the rules of attribution under the ARSIWA. Resumé: Cílem tohoto příspěvku je zhodnotit postavení veřejných korporací podle ustano- vení Evropské úmluvy o lidských právech (dále jen „EÚLP“) s přihlédnutím také k otázce jejich subjektivity v mezinárodním právu. Za účelem dosažení tohoto cíle autorka, zaprvé, rozebírá právní postavení veřejných korporací jako stěžovatelů na základě ustanovení člán- ku 34 EÚLP a, zadruhé, analyzuje přičitatelnost chování veřejných korporací státu, jak je uvedeno v článcích 4, 5 a 8 Článků o odpovědnosti států za mezinárodně protiprávní chování (dále jen „ARSIWA“). Autorka dospívá k závěru, že určité typy veřejných korporací získaly status oběti v řízení před Evropským soudem pro lidská práva (dále jen „ESLP“), a tedy je možné hovořit o jejich subjektivitě v mezinárodním právu. Za účelem zjištění toho, zda určitý subjekt může tvrdit, že se stal obětí porušování lidských práv, ESLP vypracoval „NGO test“. Tento test ESLP je ve mnohých aspektech shodný s pravidly přičitatelnosti podle ARSIWA. She gives lectures on Public International Law, Case-Law of the ECtHR, Protection of Human Rights in Europe and International Protection of Human Rights.
