CYIL 12 (2021) Selected Issues of the Responsibility of the State of Israel and Palestine… Selected Issues of the Responsibility of the State of Israel and Palestine for Violations of Obligations Stemming from International Humanitarian Law in Connection with the Action of Palestine at the International Criminal Court Veronika D’Evereux Abstract: Since 1967, the State of Israel has been carrying out a military occupation of the West Bank, which is considered Palestinian territory. Another part of the Palestinian territory is the Gaza Strip, the occupation of which was carried out by the State of Israel ended in 2005. Palestine has long sought full independence and has a strong interest in being considered a state by the international community. In 2015, the International Criminal Court approved Palestine’s application and thus Palestine became a state party of the Rome Statute. Palestine brought a case concerning all criminal acts committed in the territory of Palestine since 13 June 2014. The paper deals primarily with the issue of individual criminal responsibility for perpetrators of the war crimes in connection with this case. The paper also deals with the violations of obligations of states stemming from the international law in relation to the armed conflicts. Resume: Stát Izrael od roku 1967 vykonává vojenskou okupaci vůči území Západního bře- hu, který je považován za palestinské území. Další částí palestinského území je pásmo Gazy, jehož okupaci stát Izrael v roce 2005 ukončil. Palestina dlouhodobě usiluje o plnou nezávis- lost vůči státu Izrael a má velký zájem na tom, aby byla mezinárodním společenstvím po- važována za stát. V roce 2015 vyhověl Mezinárodní trestní soud žádosti Palestiny o členství na Římském statutu. Současně byla podána žaloba ve věci veškeré trestné činnosti spáchané na území Palestiny státem Izrael od 13. 06. 2014. Příspěvek se zabývá především otázkou individuální trestní odpovědnosti pachatelů válečných zločinů ve spojení s předmětnou ža- lobou, ale obsahuje rovněž i úvahy o odpovědnosti státu Izrael a Palestinské autonomie za porušení závazků v oblasti dodržování mezinárodního práva ozbrojených konfliktů. Key words: responsibility, crimes, Palestinian territories, ICC About the Author: Veronika D’Evereux holds a master’s degree in law and legal science from the Pan-European University in Bratislava, Slovak Republic and a doctoral degree in International Law from the Faculty of Law of Charles University in Prague, Czech Republic. In 2020, she defended her dissertation theses called International Legal Issues Related to the Status of the State of Israel. She currently works as a lawyer at the Integration Centre Prague. She is a member of the Department of Public Law and Public Administration at the Cevro Institute where she works as a senior lecturer and teaches European law and Public International law. Her publishing activities are mainly focused on the issue of the state from the perspective of the international law and various international legal aspects of the Israeli- Palestinian conflict.
