STREAMLINING OR SURVIVAL? OUTCOMES OF THE HUMAN RIGHTS TREATY BODY REVIEW Jan Lhotský Abstract: The system of human rights treaty bodies faces major challenges such as significant lack of cooperation on the part of states, lack of coordination and efficiency, as well as lack of capacity to deal with the rising workload. Recently, member states of the UN carried out a ‘treaty body review’ process which aimed at identifying measures to eliminate the problems in the system. This article critically assesses the outcome of the review and concludes that the minor improvements suggested do not address key problems within the system. In the short-term, the article calls for an introduction of a predictable schedule for state reviews and more support from UN member states for the system. Furthermore, it suggests that there should be another review in 2030 to identify long-term measures. For this purpose, it outlines a possible solution in the form of an Integrated Treaty Body System which would increase the current capacities of the system and enable it to operate in a more coherent way. Resumé: Systém lidskoprávních smluvních orgánů sídlících v Ženevě se potýká s podstat nými problémy, jako je značný nedostatek spolupráce ze strany států, potřeba zvýšení ko ordinace a efektivity, a rovněž nedostatečná kapacita pro zvládání rostoucího pracovního zatížení. Členské státy OSN nedávno provedly proces tzv. přezkumu smluvních orgánů, jehož cílem bylo určit opatření k odstranění problémů smluvních orgánů. Tento článek kriticky hodnotí výsledky přezkumu a dochází k závěru, že navržená drobná zlepšení neřeší klíčové problémy systému. V krátkodobém horizontu autor vyzývá k zavedení předvída telného harmonogramu státních přezkumů a k větší podpoře systému ze strany členských států OSN. Dále navrhuje, aby se v roce 2030 uskutečnil další přezkum, který by určil dlouhodobá opatření. Za tímto účelem nastiňuje možné řešení v podobě tzv. integrovaného systému smluvních orgánů, který by zvýšil současné kapacity smluvních orgánů a umožnil jejich fungování jako jednotného systému.
