PETRA PRESSEROVÁ CYIL 14 (2023) THE CONCEPT OF DUE DILIGENCE IN THE CONTEXT OF VIOLENCE AGAINST WOMEN: SCOPE, SPECIFICS, & CRITIQUE Petra Presserová Abstract: The objective of the article is to discuss the concept of due diligence in the context of the protection of women against violence. Through normative and case law analysis, it focuses on the particular scope of this standard and its specifics, offering its distinctive conceptualisation and subsequent critique of its scope. Firstly, the article maps due diligence’s outlines – ranging from the obligation of prevention to obligations to investigate, prosecute, and provide redress for victims – in light of international organisations’ documents, the practice of the CEDAW Committee and regional human rights courts. Secondly, drawing also from her experience with direct work with victims, the author acknowledges that due diligence and its applicability became an integral and crucial tool in the area of protection against violence. At the same time, its specific content and scope might still improve in order to more adequately and safely serve the victims themselves. Resumé: Cílem článku je představit koncept due diligence , neboli náležité péče či bdělosti, v kontextu ochrany před násilím na ženách. Prostřednictvím normativní analýzy a rozboru rozhodovací praxe se zaměřuje na jeho obsah a specifika. Nabízí tak jeho konceptualizaci a následnou kritiku jeho obsahu. Za prvé, článek mapuje specifický rozsah due diligence – a to od preventivní povinnosti přes povinnost vyšetřit čin, odstíhat pachatele až po závazek odškodnit oběť – ve světle normotvorby mezinárodních organizací a rozhodovací praxe Vý boru CEDAW a regionálních lidskoprávních soudů. Za druhé, autorka i na základě svých zkušeností z přímé práce s oběťmi uzavírá, že due diligence a její aplikace se stala integrál ním a zásadním nástrojem v oblasti ochrany před násilím na ženách. Zároveň se vlastní obsah a rozsah tohoto standardu může stále zlepšovat tak, aby co nejlépe sloužil samotným obětem.
