CYIL 14 (2023) EARTHQUAKES IN TÜRKIYE AS A VIOLATION OF HUMAN RIGHTS… would be that proper disaster management and supervision of the state in complying with regulations are absolutely essential. Although the normative basis of the state has shown positive changes in human rights instruments while implementing the judgments of the ECtHR, the reports of human rights organizations claim insufficient state action towards the protection of human rights. Following the crucial role of the ECtHR and its judgments, decisions, and rulings in Türkiye, where almost 90% of judgments were executed in the state, there is a path to improve the level of compliance with the positive obligations of the state once the Court develops its previous recommendations regarding the state’s actions in preparedness for earthquakes and their consequences for minimizing atrocities and violations of human rights. Having said that, and as was underlined by the experience and several applications and Court’s judgements, it is crucial for the protection of the human rights, as right to life, that one such action might be stricter regulation and supervision by the state of building standards for construction in seismically active areas.
