CYIL 7 ȍ2016Ȏ DO THE EUROPEANS HAVE THE RIGHT TO GET INFORMATION ABOUT… DO THE EUROPEANS HAVE THE RIGHT TO GET INFORMATION ABOUT THE OSTROVETS NUCLEAR POWER PLANT IN BELARUS? Abstract: The article discusses the current problem of the construction of a nuclear power plant in Ostrovets, Belarus and the right of the neighbouring states and their inhabitants to receive information about the planned activity. In order to answer the question about the right to receive information, the authors dwell on the significance of information in the context of national security. The article further discusses the emergence of the right to information on the international plane. The second part of the article discusses the particular legal rules embodied in international legal treaties. Firstly, the provisions of the Convention on Nuclear Safety related to the provision of information are discussed. Secondly, the Espoo Convention related to the environmental impact assessment is analyzed and the practice of the Compliance Committee of the Espoo Convention regarding Belarus is discussed. Lastly, the compliance of Belarus with the provisions of Aarhus Convention is discussed in depth. Resumé: Článek pojednává o aktuálním problému s výstavbou jaderné elektrárny Ostroves v Bělorusku, a právu sousedních států a jejich obyvatel dostávat aktuální informace o plánované výstavbě. Aby bylo možné odpovědět na otázku o právu na informace, autoři se zaměřili na význam informací v kontextu národní bezpeč- nosti. Článek dále popisuje vznik práva na informace na mezinárodní úrovni. Druhá část článku popisuje konkrétní právní normy obsažené v mezinárodních smlouvách. Za prvé, jsou diskutovány ustanovení Úmluvy o jaderné bezpečnosti v souvislosti s poskytováním informací. V druhé řadě je analyzována Úmluva z Espoo, vztahu- jící se k posuzování vlivů na životní prostředí a dále praxe výboru pro dodržování Úmluvy z Espoo, pokud jde diskusi ve vztahu k Bělorusku. A konečně se článek zabývá souladem kroků Běloruska s ustanoveními Aarhuské úmluvy, která je rovněž široce diskutována. Birutė Pranevičienė is a professor of Law at Mykolas Romeris University (Lithuania). Since 2003 she is Head of the LawDepartment in the Faculty of Public Security.
