CYIL 8 ȍ2017Ȏ MIGRANT INTEGRATION AS A NEW EU AGENDA MIGRANT INTEGRATION AS A NEW EU AGENDA Harald Christian Scheu Abstract: This paper deals with conceptual and practical questions related to EU involvement in the migrant integration agenda. Firstly, we ask how the concept of integration can be defined for the purpose of EU law. Which kind of incentives and support for member states action shall be considered? Which different fields of law are involved? Secondly, we will look at concrete EU competences in the area of migrant integration? In some fields of integration law the EU has quite important competences which go far beyond mere incentives and support for Member States. However, in some other fields the role of the EU is rather weak. In this paper we express scepticism towards the diffusion of the ideology of cultural diversity and multicultural societies by means of EU actions plans and project funding. On the other hand, EU migration and asylum law as a crucial part of the area of freedom, security and justice will not function properly without an effective coordination of national integration policies. Resumé : V tomto příspěvku se zabýváme koncepčními a praktickými otázkami týkajícími se zapojení EU do integrace migrantů. Nejprve se věnujeme problému právní definice pojmu integrace v kontextu práva EU. Které oblasti práva jsou zahrnuty do integrace jako složitého sociálního procesu? Za druhé budou vymezeny konkrétní pravomoci EU v oblasti integra- ce přistěhovalců. V některých oblastech integračního práva má EU poměrně významné kompetence, které přesahují rámec pouhých podpůrných a koordinačních pravomocí. V ně- kterých oblastech integrace je však úloha EU spíše slabá. V tomto příspěvku vyjadřujeme skepsi vůči současnému šíření ideologie kulturní rozmanitosti a multikulturních společností prostřednictvím akčních plánů EU a financování projektů ze strany EU. Na druhou stranu, migrační a azylové právo EU jako klíčová součást prostoru svobody, bezpečnosti a práva nemůže řádně fungovat bez účinné koordinace vnitrostátních integračních politik. On the Author : Harald Christian Scheu, Doc., Mag. phil., Dr. iur., Ph.D., educated at the University of Salzburg (Dr. iur., 1995, Mag. phil., 1996) and the University of Prague (Ph.D., 1997, Doc., 2006). He has received numerous fellowships (Max-Planck-Institut für ausländisches öff entliches Recht und Völkerrecht in Heidelberg, University of Bern, European University Institute in Florence, University of Zürich, University of Vienna). He is a member of the Council of the Government of the Czech Republic for Human Rights (since 2013) and a member of the Czech Government’s Legislative Council (since 2014). From 1997 to 2006 he lectured at the Department of International Law and since 2006 at the Department of European Law of the Law Faculty of Charles University in Prague. From 2005 to 2006 he served as Attaché for European Affairs at the Austrian Embassy in Prague. He teaches and conducts research in the fi elds of International and European Law and International Human Rights Law. Since 2015 he has been a member of the Management Board of the European Union Agency for Fundamental Rights.
