JAKUB HANDRLICA CYIL 8 ȍ2017Ȏ THE VIENNA CONVENTION ON CIVIL LIABILITY FOR NUCLEAR DAMAGE AND RADIOACTIVE WASTE MANAGEMENT: PROBLEMS REVISITED * Jakub Handrlica Abstract: The Vienna Convention on Civil Liability for Nuclear Damage of 1963 did not specifically address the issue of radioactive waste management in its provisions. The lack of explicit provisions concerning these activities in the Convention is due to the fact, that when the Convention was drafted, the development of nuclear energy was in its infancy, and there was little concern about activities at the back end of the fuel cycle. However, most recently, problems are arising from final disposal of radioactive waste raised again the questions concerning applicability of the liability regime of this Convention on various types of technologies used during radioactive waste management (storage, reprocessing, disposal). This contribution intends to deal with these issues in the light of existing scientific literature and in the light of the developments in other liability frameworks. Resumé: Znění Vídeňské úmluvy o občanskoprávní odpovědnosti za jaderné škody z r. 1963 výslovně nereflektuje procesy nakládání s radioaktivními odpady a potřebu jejich finál- ního ukládání. Skutečností je, že v době přijetí této mezinárodní úmluvy ještě nebyly známy veškeré konsekvence vývoje jaderné energetiky, zejména nebyla přikládána po- zornost technologickým souvislostem závěrečné fáze palivového cyklu. Nejnovější vývoj v této oblasti, zejména potřeba zřízení a provozu úložišť radioaktivních odpadů, činí otázku aplikovatelnosti Vídeňské úmluvy na různé typy technologií v této oblasti opět aktuální. Příspěvek si dává za cíl analyzovat problém aplikovatelnosti Vídeňské úmluvy ve vztahů k různým typům zařízení, používaným při nakládání s radioaktivními odpady (mezisklady, závody k přepracování, úložiště) a to jak ve světle existující odborné literatury, tak i ve světle vývoje v jiných mezinárodních odpovědnostních systémech.
