CYIL 9 ȍ2018Ȏ POVERTY ERADICATION – CONTROVERSIES BETWEEN UN AND WTO on the right of states to promulgate laws and regulations concerning the entry of aliens and the terms and conditions of their stay, 82 where this is necessary in the interests of the state. 83 The International Convention on the Protection of the Rights of All Migrant Workers and Members of Their Families stipulates that “nothing shall affect the right of each State Party to establish the criteria governing admission of migrant workers and members of their families”. 84 The fact that each and every state has its own understanding of temporariness that may vary from several months to 5 consecutive years 85 is an additional factor that stands in the way of regulating migration within the GATS. Since the international community of states agreed upon the importance and effectiveness of multilateral trading system in poverty eradication and economic growth for all, it is important to agree upon the common understanding of temporary migration for the purposes of international trade and to apply this understanding in practice. The number of diverse categories of temporary migrants amongst others (temporary migrant workers, 86 short-term migrant, 87 transients, 88 migrant worker, 89 project-tied worker, 90 self-employed worker, 91 circular migrant 92 ), shows the utmost importance of the matter. GATS can be used as an effective pillar for regulating migration related issues while respecting the concept of sovereignty and security of states.
