Střety zájmů při ochraně biodiverzity a klimatu

Climate Aspects in EIA of Intensive Livestock: An Empirical Assessment of Practice in the Light of EU and Czech Law Lucie Zdráhalová 1 Abstract: Intensive livestock farming is a significant source of greenhouse gas emissions and, at the same time, a potentially vulnerable sector in the face of climate change impacts. Both European and national legal frameworks require that climate protection be integrated into the environmental impact assessment (EIA) of proposed projects. This contribution is based on doctoral research focused on the legal regulation of climate related aspects in intensive livestock farming. It examines whether and how these legal requirements are effectively reflected in administrative decision-making practice. Drawing on selected case studies, the article evaluates whether climate impacts are assessed in detail—potentially resulting in conditions being imposed within the EIA process—or whether they are merely addressed in a formalistic manner. In doing so, the analysis highlights the potential tension between the normative requirements of the legal framework and the content of administrative decisions in practice. The conclusion raises the question of whether the EIA process for intensive livestock installations can serve as a genuine climate protection tool, or whether it continues to function largely as a formal procedure with limited substantive regulatory effect in the area of climate change mitigation. Evropský i vnitrostátní právní rámec vyžaduje, aby ochrana klimatu byla součástí posouzení vlivů záměrů na životní prostředí. Příspěvek vychází z disertačního výzkumu zaměřeného na klimatické otázky v právní regulaci intenzivních chovů hos podářských zvířat a soustředí se na to, jestli a jak jsou tyto požadavky skutečně promí tány do rozhodovací praxe. Na základě vybraných záměrů příspěvek vyhodnocuje, zda tyto vlivy bývají hodnocené podrobně, případně dokonce promítnuty do podmínek
