CYIL vol. 10 (2019)

CYIL 10 ȍ2019Ȏ THE RIGHTS OF THE ELDERLY IN THE CASEǧLAW OF THE CONSTITUTIONAL COURT … bodies are usually representatives of the relevant parliamentary minority (for instance, in the cases of taxation of old-age pensions) or ordinary courts (for instance, as for the reduction limit for the calculation of the percentage amount of pension or unequal treatment of men and women caring for children). It is therefore a specific political disagreement on certain issues or litigation that leads to the case-law activity of the Constitutional Court in this area. Despite this, it is the area of old-age pensions, that means the rights of the elderly to social security in old age, where the Constitutional Court in its decision-making repeatedly weighs important issues concerning the rights and quality of the life of the elderly.
