PETR STEJSKAL CYIL 10 ȍ2019Ȏ THE INTERPLAY OF FIELDS OF INTERNATIONAL LAW IN CASE OF FOREIGN INVESTMENTS AFFECTED BY ARMED CONFLICT 1 Petr Stejskal Abstract: The topic of protection of foreign investments has been intensively discussed from different perspectives. One of the questions arisen recently is the relationship between the norms of international humanitarian law (IHL), human rights law (IHRL) and international investment law (IIL) in situation of armed conflict. The point is that assets representing foreign investment in the sense of IIL can also represent a civilian or military object in the sense of IHL and private property in the sense of IHRL. This paper therefore describes relevant norms of IIL, IHL and IHRL which are typically triggered in armed conflicts (international, including belligerent occupation, and non-international) and then identifies and explains possible contradictions between them in particular scenarios. The paper then introduces a possible methodological model for identification and solution of norms conflicts. Resumé: Téma ochrany zahraničních investic v době ozbrojeného konfliktu je dnes inten- zivně diskutováno z několika perspektiv. Jednou z otázek, které jsou aktuální v poslední době, je vztah norem práva ozbrojených konfliktů (IHL), lidských práv (IHRL) a práva za- hraničních investic (IIL), které jsou v ozbrojeném konfliktu dotčeny. Hodnoty představující zahraniční investici ve smyslu IIL mohou současně být civilním nebo vojenským objektem ve smyslu IHL či soukromým majetkem ve smyslu IHRL. Tento příspěvek proto identifi- kuje relevantní normy těchto odvětví, které jsou typicky během ozbrojených konfliktů (me- zinárodního, vč. stavu okupace, a vnitrostátního) dotčeny a dále identifikuje a vysvětluje možné kontradikce mezi těmito normami v konkrétních situacích. Příspěvek v návaznosti na to přichází s možným modelem pro identifikaci a řešení konfliktu norem. Petr Stejskal, LL.M. is a Ph.D. candidate at the Law Faculty of the Palacky University in Olomouc. He focuses on the topic of protection of foreign investments in armed conflict. During his doctoral studies, he also conducted internships at the Embassy of the Czech Republic in The Hague and at permanent missions of the Czech Republic to the UN in Geneva or New York. Recently, he was a visiting researcher at the South African Research Chair in International Law where he worked on the topic of utilisation of transboundary groundwater.
