CYIL 10 ȍ2019Ȏ INTERNATIONAL SOCIAL SECURITY COORDINATION TREATIES … INTERNATIONAL SOCIAL SECURITY COORDINATION TREATIES FROM THE CZECH POINT OF VIEW Sandra Brožová Abstract : The contribution will focus on the application of the Vienna Convention on the Law of Treaties provisions codifying interpretative rules on a special branch covered concurrently by international, internal and European law: international coordination of social security systems with regard to individual cases brought to courts. The contribution will analyze the approach of Czech courts and executive bodies to the interpretation of international social security coordination treaties. The identified prevailing methods and directions of the Czech interpretation will then be confronted with the European level, represented by binding interpretation expressed by the Court of Justice of the EU. Resumé: Tématem příspěvku je uplatňování kodifikovaných pravidel výkladu mezinárod- ních smluv ve Vídeňské úmluvě o smluvním právu, a to se zvláštním zaměřením na odvětví mezinárodní koordinace sociálního zabezpečení, regulované současně mezinárodním, unij- ním i vnitrostátním právem. Příspěvek analyzuje přístup českých soudů a správních orgánů k interpretaci mezinárodních smluv o koordinaci sociálního zabezpečení v projednávaných případech konkrétních pojištěnců. Jsou identifikovány převládající metody a směry výkladu českých soudů a ty jsou následně konfrontovány s přístupem na unijní úrovni, představova- ným závaznou interpretací vyjádřenou Soudním dvorem EU. JUDr. Sandra Brožová, Ph.D., LL.M. , Faculty of International Relations, University of Economics in Prague, e-mail: xbros00@vse.cz or brozova@europe.com Introduction In 1919, after the First World War, the newly established postwar system of international relations founded new institutions called international intergovernmental organizations which began to possess and actively use their own international personality, a feature which had formerly only belonged to sovereign states. International personality was first recognized for the League of Nations, endowed with unprecedented competences to maintain international peace and security. 1 In the same year, the International Labour Organization was founded with its seat alongside the League of Nations in Geneva. Its principal task is to “promote rights at work, encourage decent employment opportunities, enhance social protection and strengthen dialogue on work-related issues.” 2 This contribution will be connected to another important anniversary this year 2019, namely fifty years since the signing of the Vienna Convention on the Law of Treaties on 23 May 1969 in Vienna. It is one of the most important international law codifications. This article will deal with treaty interpretation, which is also codified by the above-mentioned convention. This article will focus on some particular treaties to develop a specialized research topic.
