Universal, Regional, and National Ways of Regulation of Jurisdiction and Arbitration Agreements Kateřina Zabloudilová
Abstract: subjects of international commercial transactions are free to choose which court or courts shall have jurisdiction over the disputes arising between them. What is more, they may even arrange that the disputes shall be resolved in arbitration by a nongovernmental decisionmaker. Thus, subjects of international commercial transactions conclude arbitration and jurisdiction agreements which are governed by legal instruments on international, regional, and national levels. Naturally, the question arises whether considerable differences exist in the regulation of jurisdiction and arbitration agreements under various legal instruments. The answer to this question is necessary wherever the parties conclude such an agreement. Resumé: subjekty soukromoprávních vztahů s mezinárodním prvkem jsou oprávněny zvo- lit místo řešení svého sporu, jakož i to, zda spor bude řešen před rozhodci, či před národ- ními soudy. V praxi tak nezřídka dochází k uzavírání dohod o volbě sudiště (rozhodčích a prorogačních smluv), jež jsou upraveny instrumenty na mezinárodní úrovni, evropské úrovni i instrumenty na úrovni národní. Přirozeně se nabízí otázka, zda mezi těmito instru- menty existuje soulad ve způsobu, jakým institut dohody o volbě sudiště regulují. Odpověď na uvedenou otázku je nezbytná všude tam, kde smluvní strany uzavírají závaznou dohodu o způsobu řešení jejich sporu. Moreover, she works as a judicial assistant at the Supreme Court of the Czech Republic. She is mainly interested in International Trade Law, Arbitration, Civil Procedure, and Private International Law. In her thesis, she focuses on recognition and enforcement of both arbitral awards and court decisions. Moreover, she participated in Willem C. Vis International Commercial Arbitration Moot and worked as a team coach.
