CYIL vol. 15 (2024)
VERONIKA D’EVEREUX governing such grants .’ 70 It can be agreed, that the main message of this ruling is still up to date, as long as it is understood in the way that nowadays states stipulate domestic legal rules for registering the ships and these rules reflect the will of the state in this regard. However, in 1905 there was not yet established the obligation of the state to ensure granting the nationality to the child born or found in the territory, in case the child is not able to acquire the nationality of their parents. In the author’s opinion the examined doctrinal opinion could be nowadays still quoted. Perhaps it might be useful if there is included a brief note that from the perspective of current international law, it can be considered rather as a historical doctrinal opinion, which mostly does not reflect the present provisions of international law.
