JAN ONDŘEJ – MAGDA UXOVÁ CYIL 7 ȍ2016Ȏ ovládá určité území a má ambice stát se státem. Jeho samotný název může k tomu- to závěru směřovat. Činy Islámského státu a jeho bojovníků podléhají právnímu postihu. Rada bezpečnosti OSN v rezoluci 2170 z roku 2014 připomíná, že roz- sáhlé a systematické útoky přímo proti civilní populaci z důvodu jejich etnického nebo politického základu, náboženství nebo víry mohou konstituovat zločiny proti lidskosti. K zásahu států mezinárodního společenství, který směřuje k potlačení Islámského státu, dochází na území, který tento aktér ovládá, tj. v Iráku a v Sýrii. Na jím ovládaném území probíhá několik ozbrojených konfliktů. Státy musí být schopny bránit se v souladu s právem na individuální a kolektivní sebeobranu jak je vyjádřena v čl. 51 Charty OSN, v případě, kdy vláda státu kde je zdroj hrozby (tím se má na mysli Sýrie) je neochotna nebo neschopna zabránit použití jejího území pro takové útoky. Pokud jde o vojenské zásahy na podporu Iráku a Sýrie ze strany USA, Ruska a dalších států vyvstává otázka realizace práva na sebeobranu, případně uplatnění krajní nouze. He also co-authored the publication International Humanitarian Law (2010). Mgr. Ing. Magda Uxová, DiS . is a Senior Lecture in International Economic Relations at The Private University College of Economic Studies and postgraduate student at the Department of International Law of Charles University in Prague, Faculty of Law. She teaches and does research in the fields of International economic relations and international security. Introduction One of the current non-state actors which really gets intensively involved in international relations and whose existence and acts are scrutinized by international law is the radical terrorist organization called the Islamic State. This actor calling itself a “state” is in fact self-proclaimed as an independent Islamic state on the territory of Iraq and Syria, which, however, was not recognized by other states.
