HUMAN RIGHTS IN THE EUROPEAN CONSTITUTIONAL ORDER
deadline is not met. 47 While setting a shorter deadline might seem unnecessary as the available data shows that the member states generally set stricter conditions rather or in general decide sooner, this might still lead to at least more certainty for the applicants, as there is a definitive period for the possible extension. The core of the already established unified application procedure which allows non-EU nationals to apply for both a work and residence permit simultaneously 48 as explained above remains mostly the same. However, a change is introduced in the Article 7, and it establishes the right of the non-EU national to verify the additional information contained in the permit and where appropriate to have it corrected or deleted. Conclusion The Single Permit Directive II more explicitly sets the goal of trying to attract new workers, but the core of the directive remains the same. The Single Permit Directive II makes in some areas incremental but not very significant changes, especially regarding the right to information or the right to equal treatment. In other areas, that being the right to change employer or more importantly, the right to remain in the country in periods of unemployment can be quite significant to some workers as it might allow them to find another employment more easily and have a lesser impact on their personal life. This change I believe is one, if not the most significant in the entire directive. Regarding the efficiency of the system, the changes are not very significant, and I believe they won’t lead to a meaningful change. Nevertheless, based on the various communications from the EU 49 , it appears that this was not the primary objective of the recast, as the positive impact of the original directive on efficiency had already been measured. Regarding the current situation in Czech national law, only small changes will have to be taken, as most of the national legislation is already in accordance with the changes the recast directive brings. The only significant change that must be made is regarding the stay during brief periods of unemployment. Finally, I believe that the changes are generally positive ones, however in general they are so small that it is hard to believe they will have a significant impact on attracting new workers to the EU. 47 European Commission.
