vyvolává určité pochybnosti o souladu s unijním právem. Jako vhodné řešení těchto nesrovnalostí by se pak autorovi této práce jevilo převzetí koncepce relativně úspěšně fungující v UK, tj. vytvoření specializovaného orgánu rozhodujícího spory z těchto žalob. Byť na druhou stranu je třeba zdůraznit, že toto opatření by v žádném případě nebylo samospasitelné. Právě naopak by bylo vhodné jej doplnit o opatření další, ze- jména z oblasti civilně procesní. Abstract The purpose of the study is to analyse selected legal provisions of UK Competition Law as well as selected judgements. The special attention is also paid to the question, whether a UK Competition Law could be an interesting source for the Czech lawmakers or not. The study is composed of three chapters, each of them dealing with different aspect of the antitrust claims for damages. Chapter One is introductory and defines basic terminology used in the study. Chapter Two consists of two parts. Part One focuses on legal basis for antitrust claims for damages. Part Two examines relevant judgements of UK courts. Conclusions are drawn in Chapter Three. The study emphasizes that Czech legal provisions governing antitrust claims for damages are in breach of European Union Law. According to the author of this study the optimal solution lies in the following UK example and in the creating specialized authority which would deal with antitrust claims for damages. On the other hand it should be stressed the fact that this would be only the first step on the long road to ensure truly effective private enforcement of Competition Law.
